BALANGA CITY, Bataan – Smoking, selling or advertising of electronic or E-cigarettes and other tobacco products are definitely banned in Bataan province.
The prohibition was contained in an ordinance passed last Monday by the Sangguniang Panlalawigan (provincial board) of Bataan during its regular session held at a Balanga restaurant. It was approved unanimously by board members who were all present in the session.
Entitled: “An Ordinance Prohibiting The Use, Sale, Distribution, and Advertisement of Cigarettes and other Tobacco Products, and Electronic Cigarettes, in Certain Places, Imposing Penalties For Violations Thereof and Providing Funds Therefor, And For Other Purposes,” the provincial legislation passed the third reading with applause.
Board Member Aris Gaza, chair of the board’s committee on health, who authored the ordinance, explained that under the 1987 Constitution, the state or the government shall protect and promote the right to health of the people and instill health consciousness among them.
Gaza said the provincial government of Bataan recognizes that local governments must act with urgency to deformalize the culture of smoking and tobacco consumption through comprehensive and proven effective tobacco control measures.
Violators will be fined P1,000 for first offense; P2,000 for second, and P3,000 for third, or imprisonment. For those who are caught selling cigarettes, and other tobacco products will be fined P2,000 for first offense, P3,000 for second, and P5,000 for third and subsequent offense.
